JULY 2020 VISA BULLETIN: PROGRESS FOR PHILS AND WW EB-3


The Department of State has just issued the July 2020 Visa Bulletin. This is the tenth Visa Bulletin of Fiscal Year 2020. This blog post analyzes this month's Visa Bulletin.

MU Law Analysis

This Visa Bulletin continued the big progressions that we saw in the June Visa Bulletin.  MU Law has been calling on the DOS to rapidly advance the dates so that all immigrant visas are used in 2020.  Many visas appear that they will go unused without this progression. 

The Worldwide EB-3 dates moved almost six months are now at April 2018, as is the Philippines EB-3.  We continue to expect big progressions in these categories for the August and September VBs because very few visas were used due to the global shutdown caused by COVID-19.

The Indian EB-3 dates moved ahead two months.  It continues to move at a quicker rate than we have seen in years.  India EB-2 even advanced a month.  China EB-2 and EB-3 advanced by one week.  We might see continued progressions of a few weeks or months in these categories for the rest of the fiscal year.

The EB-1 movements were also reassuring.  As was the case last month, India EB-1 progressed another 10 months, reflecting reduced demand.  China EB-1 advanced by a week, as the DOS remains concerned about pending demand.  Limited progressions in EB-1 and EB-2 categories in the future could mean that more visa numbers flow down to EB-3, which would mean more advancement.

    1. I could see the Phils EB-3 move toward the end of 2018 in August. If the HWRA is enacted, everything is, of course, current for RNs and MDs.

    Are there any looming retrogression before the fiscal year of 2020 ends? I'm an EB-3 RN applicant in the Philippines with a priority date of June 26, 2018.

    1. I could see the Phils EB-3 move toward the end of 2018 in August. You should contact your attorney on the 221g. The 221gs have to be handled on a case by case basis.

    1. they said its because Embassy has been closed and no visa issuance recently so VB needs to be publish either way based on inventory i think.

    2. It is not yet resolved. I know someone had their interviews 1st wk ok July (yes they are open, usem manila!) same result 221g and one of your atty in Musillo group is their atty.

    1. Hi were on the same boat. I have a feeling that VB progression possibly will slow down once Embassies starts operating. 3 things to consider 1 end of fiscal year usually results to retrogression or no movements this is bcs visa allotment has been exhausted
      2 No visa issuance recently due to covid lock down therefore more visa availability
      3 New fiscal year starts in october

      my conclusion:
      Our PD will be current august or September but 100% sure in October however, when do we get an interview? that will be a BIG QUESTION to think about the huge backlogs probably December or 2021 :( Unless they prioritize health worker interviews

    1. I had the same thinking No interviews = No visas issued therefore VB progression
      What if Visa interviews resume and 221g cases approval = visa issuance then possible retrogression again?

    4. @lovely yes that is true but how about family based and H1b and other non immigrant visa categories? chances are visa interview for current will be scheduled within 6 mos or longer. God i hope not its gonna take soo long LOL

  13. Hi MU,

    ​I attended the GC interview after downgrading(EB2 to EB3) after the filing dates for eb3 was favorable. The Field Officer who was interviewing me was referring to my EB2 app for the entire interview. I told him I'm EB3. He mentioned he will send GC whatever dates become current? My dates are now current for July under Eb2 INDIA. Should I expect a GC? Is it possible for them to give me a GC even without letting USCIS letting us know about the interfile option? Appreciate your response

    1. Its a common trend to have a retro when the Fiscal year ends on September. But it will progress again on the start of the new fiscal which is in October where the pool of visas will replenish to its maximum limit.

If the HWRA be enacted this year, do you think it will somehow indirectly benefit other Filipino HCWs like us who are waiting for our PDs to be current because nurses will have their own visa allocation and will no longer compete with the PH eb3 visa allocation .?   18. Hi Chris! A lot of people are anticipating a huge visa spillover to the EB category next fiscal year which will come from the unused family based visas this year. Assuming that the spillover will actually happen, do you think that EB3 Phils will benefit from this? Or the spillover will just go to the most backlogged country? Thanks!

    I just want to ask if you happen to know how the Philippine US embassy will work on the physical exam and interview of nurses under eb3 when domestic flights are cancelled and there are a lot of nurses like me who are from provinces and still have to travel to manila for the PE and interview. Thanks a lot.

    1. You will still need to get to the embassy and get to the medical exam. Your interview will have to be cancelled or postponed if you cannot attend.
