JUNE 2020 VISA BULLETIN: PROGRESS FOR PHILS AND WW EB-3; EB-1


The Department of State has just issued the June 2020 Visa Bulletin. This is the ninth Visa Bulletin of Fiscal Year 2020. This blog post analyzes this month's Visa Bulletin.

MU Law Analysis

This was another eagerly anticipated Visa Bulletin.  The DOS moved the Philippines and Worldwide EB-3 ahead by 10 months, which is encouraging.  The Indian and Chinese EB-3 dates moved ahead one month, which is also a promising sign. It would not surprise us to see another big progression in the July Visa Bulletin, especially for the Philippines and Worldwide EB-3s. 

The EB-1 movements were also reassuring.  India EB-1 progressed 10 months.  China EB-1 advanced by a month.  The Indian and Chinese EB-2 dates also moved ahead, with India progressing by 10 days and China by one month.  These progressions could mean that more visa numbers flow down to other categories.

MU continues to believe that the State Department should be accelerating these dates at a faster rate and will need to aggressively accelerate the dates in the next few months in order to ensure that all visas are used in fiscal year 2020.  We have said this for several months.  Very few immigrant visas have been issued in the last 60 days because of the COVID-19 crisis. 

Conspiracy rumors are out there.  Some are speculating that the White House is interfering and illegally holding back progressions. The State Department did not include any comments at the end of the Visa Bulletin.  This lack of transparency from the State Department is feeding the speculation.  At the very least the State Department should explain how it expect to use this year’s full allotment of immigrant visas.

      we have same PD. I am quite unmoved by this push and pull visa bulletin progression. Been so disappointed but my guess would be August VB. interview maybe sched by November

    what if the US Embassy Manila is still close on June. wht will happen to those people who have interview dates that month?

      They will need to reschedule the interviews. My sense is that the Embassy will start to open in June.

    Good day Atty! Does the visa allocation for every fiscal year must be utilized or exhausted or the government has the final say whether to hold back the issuance even if there are sufficient applicants who are qualified to receive the visa?     Hello attorney, sorry for asking but im planning to get married with my dual citizen fiance, he is born in Spain with Filipina mom. Can we get married under the PH law and add him to my application. By the way I was already interviewed and placed under 221g.im sorry if it's too much to ask.

      You must be married before the issuance before the visa is issued by the embassy. You may even want to consider withdrawing your IV petition at the embassy.

    Good day atty. My question is related to HWRA
    Is it true that if you dont have a visa screen certificate even if you have approved 1-40 you wont get a visa ? So even if youre pd is May 2020 as long as you have a complete documents you will get a visa first ? Compared to those you dont have it or to those that are going to renew their visa certificate ?       A Visascreen certificate is needed for embassy interview. You wont’t be given a visa because you lack one of the requirements.

      You must obtain a visa screen prior to your visa interview. This legislation only speeds up the process, it does not change the process.

      As atty previously mentioned, HWRA does not affect the USCIS approval or decision. This Bill will only remove retrogression on Priority dates filed prior to June 11. The process will follow through first come first serve basis. So reserve your spot in the line that is the ultimate goal

      also, Priority Dates must be approved to qualify. A refile can be done for Unapproved priority dates with New Priority date

    My PD is June 28, 2018 I am one of the casualties( sorry for the term) of March 2020 VB where we thought it will become current instead it retrogress to January 2017. Do you think next July VB will Be our time?
