SEPTEMBER 2018 VISA BULLETIN: DON'T PANIC! ALL WILL BE FIXED ON OCT 1


 DON'T PANIC ABOUT THIS VISA BULLETIN!

The Department of State has just issued the September 2018 Visa Bulletin.  This is the final Visa Bulletin of Fiscal Year 2018.  This blog post analyzes this month's Visa Bulletin.

Table A: Final Action Dates -- Applications with these dates may be approved for their Green Card (Permanent Residency card) or Immigrant Visa appointment.

Table B: Dates for Filing -- The DOS may work on applications with these dates. But the Visa cannot be approved until the date is current per Table A.

MU Law Analysis (all references are to Table A unless noted)

 This Visa Bulletin retrogressed all categories several years.  This is the Department of State's signal that all employment-based visas have been used for this fiscal year.  This is normal and happen at the end of each fiscal year.  The new fiscal year starts on October 1, 2018.  This Visa Bulletin includes a note confirming that "the implementation of the above mentioned dates will only be temporary and in October, the first month of fiscal year 2019, the final action dates will be returned to those established for August."

Accordingly, things will return to normal on October 1, 2018.

    Dear Musillo - As per the august bulletin my priority date (August 2007, India) is current. Am i still eligible to apply for I 485 in August. Is this going to affect my application?

      This VB goes into effect on Sept 1. Therefore if your Table A PD is current you can file an I-485 until Aug 30.

      Yes- the October VB will look like the Aug or July 2018 VB

    What happened to those who are already current in July 2018 VB and were already scheduled for an embassy interview? Will their schedule and visa issuance be put on hold as well?

      They will have the interview if their PD is current. If not, the Embassy usually postpones the interview.

    HI MU, My i140's PD is 09/19/2016 EB2 Phils, currently Ne Scv Ctr's PD is jan 2018 and i485 PD is 10/20/2016 and currenlty Ne Svc ctr is at 09/09/16. How long do you think will this take and what would be the next steps (havent recvd any updates yet from uscis)? Thanks!

      It depends on your PD. Keep in mind that this post does not go into effect until September 1.

      Oct-Dec VBs will be retrogressed for EB-1. It should get much better after the new year.

      You should get Packet IV in Aug/Sept. You will have the interview 3-4 months after that, provided that the dates stay current, which they should.

    Hi!! My PD is February 2018 EB3 Rest of world. Just checked October 2018 Visa bulletin and my PD is current for this month. I am waiting for interview letter ( 10 weeks already). Is it possible to receive visa interview letter during September for an October/November interview date? Or Does NVC actually waits until October to start scheduling interviews for cases with a current priority date?

    Or, Do you believe I have to keep waiting a little bit longer to receive a interview date?
